Welcome to Penkam Marketplace (penkam.com). These Terms and Conditions govern your use of our platform. By accessing or using the site, whether as a visitor, buyer, or registered vendor, you agree to be bound by these terms.
1. About the Platform
Penkam Marketplace is an e-commerce platform operated by Penkam Digital Services Ltd that allows independent third-party vendors (“Vendors”) to list and sell their products, and customers (“Buyers”) to browse and purchase those products. [1]
Crucial Notice: Penkam Marketplace acts as a facilitator. The contract for sale of any product is strictly between the Buyer and the Vendor. Penkam is not a party to that contract, nor does it assume any responsibility arising out of or in connection with it.
2. Account Registration
- Users must register for an account to buy or sell on the platform.
- You agree to provide accurate, current, and complete information during registration.
- You are solely responsible for maintaining the confidentiality of your account password.
3. Terms for Vendors (Sellers)
- Product Listings: Vendors must list products in their correct, assigned categories. Vendors may not create new top-level categories. Miscategorized or prohibited items will be removed without notice.
- Pricing & Stock: Vendors are responsible for setting accurate prices (inclusive of applicable taxes) and maintaining correct stock levels.
- Fulfillment: Vendors must fulfill and dispatch orders promptly to ensure reliable delivery across Benin City and target regions.
- Commission & Payouts: Penkam Marketplace charges a commission fee on every successful sale (as detailed in the Vendor Dashboard agreement). Payouts are transferred to the vendor’s bank account after the platform’s standard escrow/holding period clears.
4. Terms for Buyers (Customers)
- Purchases: By clicking “Place Order” or “Shop Now,” you agree to purchase the product at the stated price (inclusive of tax) plus any applicable shipping fees.
- Payment: Payments must be made using the available online channels on the website. Cash on delivery is only available if explicitly stated during checkout.
- Delivery: Delivery timelines are estimates. While we work with verified logistics partners, Penkam is not liable for structural delays caused by third-party couriers.
5. Returns, Refunds, and Disputes
- Buyers must inspect items immediately upon delivery.
- Disputes regarding defective, wrong, or damaged items must be reported within 24 hours of receipt.
- Refunds will be processed through the original payment method only after the platform or the Vendor verifies the claim.
6. Prohibited Activities
Users (both buyers and vendors) may not:
- List illegal, counterfeit, or banned items under Nigerian law (e.g., weapons, unapproved drugs, stolen goods).
- Use the marketplace to bypass platform fees by conducting off-site transactions.
- Post fraudulent reviews, spam, or abusive content.
7. Limitation of Liability
To the maximum extent permitted by Nigerian law, Penkam Digital Services Ltd shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the platform, product defects, or vendor misconduct. [1]
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nigeria.
9. Changes to Terms
We reserve the right to modify these terms at any time. Changes become effective immediately upon posting to penkam.com. Your continued use of the site signifies your acceptance of the revised terms.
